TripBudget – Terms of Service

These Terms of Service (the “Terms”) constitute a legally binding agreement between you (the “User”, “you”, or “your”) and Louis Breyne, operating under the trade name “Breyne Engineering”, an independent entrepreneur registered in Belgium (VAT number BE1008.222.750) (hereinafter referred to as “TripBudget”, “we”, “us”, or “our”), governing your access to and use of the TripBudget mobile application and any related web-based services, features, content, and functionality (collectively, the “Service”).

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service.

Breyne Engineering is the sole operator and publisher of the TripBudget application.


2. Description of the Service

TripBudget is a digital expense-tracking and trip budgeting application designed to enable users to record, organize, calculate, and analyze travel-related expenses, including (without limitation) multi-currency transactions, shared expenses among participants, common pool contributions, and related trip budgeting data.

Certain features of the Service may enable synchronization across devices and collaborative access to shared trips. These features may rely on third-party infrastructure providers (including Google Firebase and Google Cloud Platform) and may require authentication.

The Service is intended solely as a personal organization and informational tool. It does not constitute a financial management platform, payment system, banking service, accounting software, or regulated financial product.


3. Definitions

For purposes of these Terms:

“Account” means a user account used to access authenticated features of the Service.

“Content” means information and data submitted to the Service by users, including trip details, participant details, expenses, notes, categories, and other inputs.

“Third-Party Services” means external services and infrastructure providers that are not operated by TripBudget but may be used to provide parts of the Service (e.g., authentication, hosting, synchronization).


4. Eligibility and Legal Capacity

The Service is intended for individuals who are at least sixteen (16) years of age.

By accessing or using the Service, you represent and warrant that you:

  1. Are at least sixteen (16) years old;
  2. Possess the legal capacity to enter into binding contractual agreements;
  3. Will comply with all applicable laws and regulations in connection with your use of the Service.

The Service is not directed to children under the age of sixteen (16), and we do not knowingly provide the Service to such individuals.


5. User Accounts and Authentication

Access to authenticated features of the Service requires authentication through Google Sign-In or through email and password using Firebase Authentication services.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your authenticated account. You agree to notify us without undue delay of any unauthorized access or suspected security breach relating to your account.

TripBudget does not have access to user passwords. Password management, hashing, and credential security are handled exclusively by Google Firebase in accordance with its own technical and contractual safeguards.

We reserve the right to suspend or restrict access to the Service (in whole or in part) in the event of suspected misuse, security threats, or violation of these Terms.


6. Account Deletion and Data Removal

Users may initiate account deletion directly within the application through the dedicated account deletion function.

Upon submission of a deletion request, the following process applies:

  • The request is securely recorded;
  • All personal data directly associated with the User’s account is permanently deleted from our accessible systems;
  • Data contained within shared trips that cannot be entirely removed without infringing upon the legitimate interests or rights of other participants will be irreversibly anonymized;
  • A confirmation email will be sent to the former User upon completion of the deletion process.

The deletion process may be completed within a few minutes but, depending on system load or data complexity, may take up to several days.

Account-related data is retained only until a deletion request is processed, subject to limited security log retention by third-party authentication providers where required for fraud prevention, security monitoring, or legal compliance.

Deletion of the application from a device does not automatically delete account data associated with authenticated features; a formal deletion request must be submitted within the application.


7. User Responsibilities and Conduct

You agree to use the Service in a lawful, responsible, and respectful manner.

You are solely responsible for:

  • The accuracy, completeness, and legality of the data you enter;
  • The allocation and division of expenses among participants;
  • The financial consequences of decisions made using information generated by the Service;
  • Ensuring that you have the necessary authorization before entering personal data relating to other individuals.

You shall not:

  • Use the Service for unlawful or fraudulent purposes;
  • Attempt to reverse-engineer, decompile, or interfere with the technical operation of the Service;
  • Circumvent security mechanisms;
  • Introduce malicious code or exploit vulnerabilities.

Any misuse of the Service may result in suspension or termination of access.


8. Collaborative Features and Shared Trips

When a User shares a trip and invites additional participants, the associated data becomes accessible to all authorized members of that trip.

TripBudget does not monitor the content of shared trips and is not responsible for disputes, financial disagreements, or inaccuracies arising between participants.

Each User remains responsible for the data they contribute to shared trips and for ensuring that such data is entered in good faith and in compliance with applicable laws.


9. No Financial, Accounting, or Legal Advice

The Service is provided solely as a digital organizational tool.

TripBudget does not provide financial, accounting, tax, investment, banking, or legal advice.

Currency exchange rates displayed within the Service are provided for informational purposes only and may originate from third-party providers. We do not guarantee the accuracy, completeness, timeliness, or reliability of such rates.

All expense calculations, balances, summaries, and analytical outputs are generated automatically based on user-provided data. Users remain solely responsible for verifying financial information before making decisions, settlements, or payments.

For the avoidance of doubt, TripBudget does not process payments, hold user funds, execute transfers, provide escrow services, or act as a financial intermediary of any kind. The Service solely facilitates the recording and calculation of expense information entered by users. Any financial settlement or payment between participants occurs entirely outside the Service and remains the sole responsibility of the users involved.


10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, TripBudget disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Implied warranties of merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Continuous, uninterrupted, or error-free operation.

We do not warrant that the Service will always be available, secure, or free from defects.


11. Limitation of Liability

To the maximum extent permitted by law, TripBudget and Breyne Engineering shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to the use or inability to use the Service.

This includes, without limitation:

  • Financial losses resulting from incorrect expense calculations;
  • Errors in exchange-rate data;
  • Data loss or corruption;
  • Service interruptions;
  • Disputes between Users;
  • Third-party infrastructure failures, including but not limited to Google Firebase services.

In all cases, our total cumulative liability shall not exceed the total amount paid by the User, if any, for use of the Service during the twelve (12) months preceding the claim. If the Service has been provided free of charge, liability shall be limited to the minimum extent permitted by applicable law.

Nothing in these Terms shall exclude liability where such exclusion is prohibited by law.


12. Third-Party Services and Infrastructure

The Service relies on third-party infrastructure, including but not limited to Google Firebase and Google Cloud Platform.

TripBudget does not control and is not responsible for the operational continuity, data processing practices, or contractual terms of such third-party providers.

Your use of the Service may be subject to additional terms imposed by those providers.


13. Intellectual Property

All intellectual property rights relating to the Service, including software code, algorithms, interface design, trademarks, logos, documentation, and related materials, are and shall remain the exclusive property of Breyne Engineering, unless expressly stated otherwise.

Users are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for personal or internal purposes.

Any unauthorized reproduction, modification, distribution, or reverse engineering is strictly prohibited.


14. Modifications to the Service

We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspect of the Service, including features, functionalities, or technical infrastructure.

We may introduce paid features or subscription plans in the future.

We shall not be liable for any modification, suspension, or discontinuation of the Service.


15. Force Majeure

TripBudget shall not be liable for any failure or delay in performance of the Service, in whole or in part, where such failure or delay results from events beyond our reasonable control.

Such events may include, without limitation, acts of God, natural disasters, fire, flood, earthquake, pandemic, governmental actions, regulatory changes, labor disputes, power outages, telecommunications failures, internet disruptions, cyberattacks, infrastructure failures, or outages affecting third-party service providers including, without limitation, Google Firebase or Google Cloud Platform.

During the occurrence of a force majeure event, our obligations under these Terms shall be suspended for the duration of such event to the extent they are affected.


16. Amendments to These Terms

We reserve the right to amend these Terms at any time.

Continued use of the Service following publication of updated Terms constitutes acceptance of such modifications.


17. Termination

We may suspend or terminate access to the Service where:

  • These Terms are violated;
  • The Service is used unlawfully;
  • Continued access poses a security or operational risk.

Users may terminate their use of the Service at any time by uninstalling the application and/or requesting account deletion.


18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict-of-law principles.

Any dispute arising out of or in connection with these Terms shall fall within the exclusive jurisdiction of the competent courts of Belgium.


19. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TripBudget regarding use of the Service and supersede any prior agreements or understandings.
